1. Introduction

Welcome to The Journey of the Secret Artist.

These Terms of Service (“Terms”) govern the use of our website, the booking and attendance
of our workshops, the purchase of any products or services offered by us, and all interactions
between you and The Journey of the Secret Artist.
By accessing our website, making a booking or attending one of our workshops, you confirm
that you have read, understood and agreed to be bound by these Terms.
If you do not agree with these Terms, you should not use our website or book our workshops.
These Terms apply to all customers, website visitors, workshop participants and purchasers
of our products or services.

2. Definitions

Throughout these Terms:

“Business”, “We”, “Us”, “Our” refers to The Journey of the Secret Artist, operated by
Kayleigh Martin as a UK Sole Trader.

“Customer”, “Participant”, “You”, “Your” refers to any individual who accesses our
website, makes a booking or attends a workshop.

“Workshop” refers to any creative session, course, class, demonstration, event or activity
organised by The Journey of the Secret Artist.

“Venue” refers to any hired location where workshops are delivered.

“Website” refers to our official website together with all associated booking systems.

“Products” refers to any physical goods sold by us including (but not limited to) art kits,
creative supplies, gift vouchers or merchandise.

3. About Us

The Journey of the Secret Artist is an independent creative workshop business based within
the Cotswolds, England.

We provide welcoming, community-focused creative workshops designed for adults aged
eighteen years and over.

Our workshops aim to encourage creativity, confidence, wellbeing and meaningful social
connection through enjoyable artistic experiences.

4. Acceptance of these Terms

By:
• browsing our website;
• making a booking;
• purchasing products;
• attending a workshop;
• communicating with us regarding our services,

you agree that these Terms form a legally binding agreement between you and The Journey
of the Secret Artist.

We reserve the right to amend these Terms from time to time.
The latest version will always be published on our website.

It is your responsibility to review these Terms before making a booking.

5. Eligibility

Unless otherwise stated:

• Workshops are intended for adults aged 18 years and over.
Participants must ensure they are physically able to take part in the workshop activities.
If you have any accessibility requirements or require reasonable adjustments, please contact
us before booking. We will make every reasonable effort to accommodate your needs where
practical and safe to do so.

We reserve the right to refuse bookings where attendance may present a significant health or
safety risk that cannot reasonably be managed.

6. Booking Workshops

Workshop places are allocated on a first-come, first-served basis.

A booking is only confirmed once:

• payment has been successfully received; and
• you receive confirmation from us.

Bookings may be made via:

• our website;
• our authorised booking platform;
• other approved booking methods as advertised.

Workshop places cannot be guaranteed until confirmation has been issued.
If a workshop reaches capacity, additional customers may be offered a place on a waiting list.

7. Prices & Payment

All prices are displayed in Pounds Sterling (£).

Workshop prices include:

• tuition;
• use of workshop materials unless otherwise stated;
• complimentary tea and coffee;
• complimentary biscuits or cake (subject to availability).

Payments must be made before attending unless otherwise agreed in writing.

We reserve the right to amend prices at any time.
Price changes will not affect bookings that have already been confirmed.

Any promotional discounts are subject to their own individual terms.

8. Cancellations & Refunds
8.1 Our Cancellation Policy

As our workshops are planned for specific dates, times and venues, each booking reserves a
place that cannot usually be resold at short notice.

We therefore operate the following cancellation policy.

More than 24 hours before the workshop:

If you cancel your booking more than 24 hours before the scheduled workshop start time,
you may choose either:

• to transfer your booking to another available workshop of equal value; or
• to receive a credit voucher for the amount paid, valid for 12 months from the date of
issue.

Cash refunds are not normally offered unless required by law.
Less than 24 hours before the workshop

Bookings cancelled within 24 hours of the workshop are non-refundable and non-transferable.
This is because your place has been reserved exclusively for you and we are unlikely to be
able to fill it at such short notice.

Failure to Attend (“No Show”)
If you do not attend a workshop without notifying us beforehand:

• your booking will be treated as a No Show;
• no refund, transfer or credit will be provided.

Exceptional Circumstances

We understand that unforeseen events occasionally occur.
At our absolute discretion, we may choose to offer a transfer or credit in exceptional
circumstances.
Examples may include:
• serious illness;
• hospital admission;
• bereavement;
• severe travel disruption.

Supporting evidence may be requested where appropriate.
Any goodwill gesture does not create a future entitlement.

If We Cancel a Workshop
If The Journey of the Secret Artist cancels a workshop due to circumstances within our
control, you will be offered the choice of:

• a full refund; or
• a transfer to another available workshop; or
• a credit voucher.
Venue Changes

Occasionally it may be necessary to change the venue due to circumstances beyond our
control.

Where possible:

• participants will be notified promptly;
• the replacement venue will be within the same local area;
• the workshop content will remain substantially unchanged.

A change of venue alone does not automatically entitle participants to a refund.
Circumstances Beyond Our Control

If a workshop cannot proceed because of events outside our reasonable control, including but
not limited to:

• severe weather;
• flooding;
• fire;
• government restrictions;
• public health emergencies;
• venue closure;
• utility failure;
• instructor illness,
we will make reasonable efforts to reschedule the workshop or offer an alternative
arrangement.

9. Transfers & Rescheduling

Participants may request to transfer their booking to another workshop.
Transfer requests:

• must be made at least 24 hours before the workshop;
• are subject to availability;
• may only be transferred to workshops of equal value unless any price difference is
paid.

Only one transfer is permitted per booking unless otherwise agreed by us.
Transfer requests made less than 24 hours before the workshop cannot normally be
accommodated.

10. Attendance

Participants should arrive approximately 5-10 minutes before the published workshop start
time.
Late arrivals may join the workshop where practical.

However, we cannot guarantee that missed demonstrations or introductions can be repeated.
Workshops will begin at the advertised time wherever possible.

Our workshops are intended to create a relaxed and enjoyable environment for everyone
attending.

Participants are expected to behave respectfully towards:

• fellow participants;
• venue staff;
• workshop facilitators;
• volunteers;
• the venue itself.

We reserve the right to refuse admission or require any participant to leave if their behaviour
is considered:

• threatening;
• abusive;
• discriminatory;
• disruptive;
• unsafe;
• intoxicated.

In these circumstances no refund will be provided.

11. Participant Responsibilities

By attending a workshop, you agree to:

• follow reasonable instructions provided by the workshop facilitator;
• use equipment safely and responsibly;
• treat fellow participants with kindness and respect;
• take reasonable care of the venue and equipment;
• disclose any relevant allergies or accessibility requirements before attending where
appropriate.

Participants remain responsible for their own personal belongings.

The Journey of the Secret Artist cannot accept responsibility for loss or damage to personal
property unless caused by our negligence.

12. Health & Safety

Participant safety is extremely important to us.
Reasonable steps are taken to provide a safe and welcoming workshop environment.
Participants agree to:

• follow all safety instructions;
• use equipment appropriately;
• immediately report accidents or hazards;
• respect venue safety procedures;
• comply with emergency evacuation instructions if required.

Where art materials are provided, participants should use them only for their intended
purpose.

Appropriate protective equipment or guidance will be provided where necessary.
We reserve the right to withdraw any equipment from use if it becomes unsafe.

A first aid kit will be available during workshops.

Where venues have designated fire evacuation procedures, participants must follow the
instructions of venue staff or the workshop facilitator.

13. Allergies & Refreshments

Complimentary tea, coffee, biscuits and cakes may be offered during workshops.
These refreshments are provided as a courtesy and are included within the workshop
experience.

Although reasonable care is taken when selecting and serving refreshments:

• we cannot guarantee that any food or drink is free from allergens;
• refreshments may have been prepared by third parties;
• ingredients may change without notice.

Participants with allergies or dietary requirements are encouraged to bring their own
refreshments if necessary.

The Journey of the Secret Artist accepts no liability for allergic reactions except where
required by law.

14. Photography & Media
14.1 General

The Journey of the Secret Artist may occasionally take photographs and short video
recordings during workshops for promotional and marketing purposes.

These images may be used on:

• Our website
• Social media platforms
• Printed marketing materials
• Newsletters
• Promotional publications
• Future advertising campaigns

We understand that not everyone wishes to be photographed, and we fully respect this.

14.2 Consent

No identifiable photographs of participants will be used without their prior consent.
Participants will be asked to complete a separate Photography Consent Form before any
identifiable images are published.

You may:

• Consent to photographs.
• Decline photographs entirely.
• Withdraw your consent at any time for future use.

Withdrawal of consent will not affect printed materials or publications already produced
before the request was received.

14.3 Photographs Taken by Participants

Participants are welcome to photograph their own artwork.
However, we ask that everyone respects the privacy of others.

Please do not publish photographs containing other participants unless you have obtained
their permission.

14.4 Artwork

We may ask permission to photograph completed artwork for promotional purposes.
Ownership of artwork always remains with the participant unless otherwise agreed in writing.

15. Intellectual Property

Unless otherwise stated, all intellectual property rights relating to The Journey of the Secret
Artist remain the property of the business.

This includes:

• Workshop materials
• Demonstrations
• Lesson plans
• Manuals
• Downloads
• Worksheets
• Templates
• Logos
• Branding
• Website content
• Photographs
• Graphics
• Marketing materials
• Social media content

Personal Use

Workshop participants are welcome to use the knowledge and skills gained during workshops
for personal enjoyment.

Commercial Use

Workshop materials may not be:
• copied;
• reproduced;
• distributed;
• sold;
• published;
• uploaded online;
• adapted for commercial purposes
without our prior written permission.

Unauthorised reproduction may result in legal action.

16. Website Use

By accessing our website you agree to use it responsibly.

You must not:

• misuse the website;
• interfere with its operation;
• upload malicious software;
• attempt unauthorised access;
• use automated systems to copy website content;
• copy our intellectual property without permission.

Accuracy

We make every reasonable effort to ensure information published on our website is accurate.

Images are provided for illustration purposes only.
Colours and materials may vary slightly.

Faulty Products
Nothing within these Terms affects your statutory rights under UK consumer law.

If products arrive faulty, damaged or not as described, please contact us as soon as reasonably
possible so we can investigate and resolve the issue.

Delivery

Delivery times are estimates only.
We cannot accept responsibility for delays caused by postal or courier services once goods
have been dispatched.

18. Gift Vouchers

Gift vouchers may be introduced in the future.

Unless otherwise stated:

• vouchers are valid for 12 months;
• cannot be exchanged for cash;
• must be used before their expiry date;
• may only be redeemed against eligible products or workshops.

Lost or stolen vouchers may not be replaced.

We reserve the right to refuse altered or fraudulent vouchers.

19. Limitation of Liability

Nothing within these Terms seeks to exclude or limit liability where it would be unlawful to
do so.

This includes liability for:

• death;
• personal injury caused by negligence;
• fraud;
• fraudulent misrepresentation;
• any other liability which cannot legally be excluded.

General Liability

To the fullest extent permitted by law, The Journey of the Secret Artist shall not be liable for:

• indirect losses;
• consequential losses;
• loss of profits;
• loss of business opportunities;
• loss of enjoyment;
• travel expenses arising from participant cancellations;
• personal belongings lost, damaged or stolen at venues unless caused by our
negligence.

Participants attend workshops at their own risk and remain responsible for taking reasonable
care whilst participating.

Property Damage

Participants may be held responsible for deliberate or negligent damage caused to:

• venues;
• equipment;
• furniture;
• workshop materials.

Personal Property

Participants remain responsible for their own possessions throughout the workshop.
We recommend that valuable items are not left unattended.

20. Force Majeure
20.1 Circumstances Beyond Our Control

The Journey of the Secret Artist shall not be held liable for any delay, interruption or failure
to perform our obligations where such failure results from circumstances beyond our
reasonable control.

Examples include, but are not limited to:

• Severe weather
• Flooding
• Fire
• Storm damage
• Pandemic or public health emergency
• Government restrictions
• National or local emergencies
• Industrial action
• Power failures
• Internet outages
• Venue closures
• Supplier failures
• Illness of the workshop facilitator
• Any other event outside our reasonable control.

Where possible, we will make reasonable efforts to:

• notify participants promptly;
• reschedule the workshop; or
• offer an alternative date or suitable remedy.

21. Data Protection

We are committed to protecting your personal information and processing it fairly, lawfully
and transparently.

Personal information is handled in accordance with:

• UK General Data Protection Regulation (UK GDPR)
• Data Protection Act 2018
• Any other applicable UK data protection legislation.

Information about how we collect, use, store and protect your personal information is
contained within our separate Privacy Policy, which forms part of these Terms.
By making a booking or using our website, you acknowledge that your personal information
will be processed in accordance with our Privacy Policy.

Marketing Communications

Where you choose to subscribe to our newsletter or marketing communications, you consent
to receiving updates from The Journey of the Secret Artist.
You may unsubscribe at any time using the unsubscribe link included within our emails or by
contacting us directly.

22. Complaints Procedure

We hope every participant enjoys their experience with The Journey of the Secret Artist.
If you are dissatisfied with any aspect of our service, we encourage you to contact us as soon
as possible so that we can work towards a fair and timely resolution.

Complaints should be submitted in writing by email to:

• Date of the workshop
• Venue
• Description of the issue
• Any relevant supporting information

We aim to:
• acknowledge complaints within 5 working days; and
• provide a full response within 20 working days, although more complex matters may
take longer.

We are committed to handling complaints professionally, fairly and respectfully.

23. Changes to these Terms

We reserve the right to amend or update these Terms from time to time.

Changes may be made for reasons including:

• changes in legislation;
• operational improvements;
• new services;
• changes to our business model;
• clarification of existing terms.

The latest version will always be published on our website.

Changes will not generally affect bookings already confirmed unless required by law or
agreed with you.

24. Severability

If any provision within these Terms is found by a court or competent authority to be
unlawful, invalid or unenforceable, that provision shall be treated as severed from the
remaining Terms.
The remainder of these Terms shall continue in full force and effect.

25. Entire Agreement

These Terms, together with our:

• Privacy Policy
• Website Cookie Policy
• Refund & Cancellation Policy (where published separately)
• Photography Consent arrangements
• Any booking confirmation issued by us

constitute the entire agreement between you and The Journey of the Secret Artist relating to
your booking or use of our services.

Nothing within these Terms affects any statutory rights available to consumers under
applicable UK law.

26. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of England
and Wales.

Any dispute arising from these Terms or the services provided by The Journey of the Secret
Artist shall be subject to the exclusive jurisdiction of the courts of England and Wales unless
applicable consumer legislation provides otherwise.
